Affiliates.Network Code of Conduct for affiliates

This Code of Conduct, as may be amended, supplemented or revised from time to time, forms an integral part of the General Terms and Conditions of Affiliates.Network

All Affiliates must comply with this Code of Conduct in full.

Article 1: Definitions

  • Affiliates.Network: Operator and administrator of the website Affiliates.Network.
  • User: Every visitor and user of the website Affiliates.Network.
  • Registration: The act whereby a Consumer actively and consciously creates an Account via one of the websites of Affiliates.Network.
  • Consumer: A natural person who registers on one of the erotic chat websites, online coaching sites as well as all underlying pages, under the control of Affiliates.Network.
  • Service: Offering a Website where a Consumer - against payment of a specified amount per message - can exchange erotic Chat Messages or other Content with purely fictitious profiles, with entertainment as the goal and where no physical dates are possible.
  • Website: The Affiliates.Network Websites, which are connected to a Central where a Consumer - against payment of a specified amount per message - can exchange erotic Chat Messages or other Content with purely fictitious profiles, for the purpose of entertainment and where no physical dates are possible.
  • Code of Conduct: Code of conduct as published by Affiliates.Network.

Article 2: Correct representation of the nature of the service

Affiliate must take into account a correct representation and marketing campaigns from which information must be visible on the Website of Affiliates.Network:

  • that the Website is a chat service;
  • that the Website is not intended for the establishment of physical appointments;
  • that the Website aims to flirt with Fictional Profiles, whereby flirting is understood to mean the exchange of erotic chat messages;
  • that the Website does not make any misrepresentations or publish misleading information;

The Website and the communication by the Affiliate may not contain any statements, images, suggestions or omissions that could confuse or mislead the Consumer about the nature and characteristics of the Services offered, namely offering a chat service where a Consumer can exchange - for payment of a specified amount per message - erotic messages or other Content with purely fictitious profiles, for the purpose of entertainment and where no physical agreements with these profiles are possible.

Article 3: Affiliate Compliance with the Code of Conduct

Affiliates.Network ensures that the Affiliates engaged by it observe this Code of Conduct, and in particular Article 2 thereof. In its agreement with its Affiliates, Affiliates.Network will stipulate that failure to comply with this Code of Conduct shall be grounds for termination. All affiliates need to comply with all guidelines set forth by relevant authorities, such as consumer and market authorities (including, but not limited to: the Dutch ‘Autoriteit Consument en Markt’, the US Federal Trade Commission and any similar authority in all relevant or applicable jurisdictions). This includes that each Affiliate must guarantee that all reviews are clear and honest and that all reviews comply with consumer and advertising guidelines regarding testimonials and endorsements, including, but not limited to: the disclosure of (i) a material connection between the endorser and Affiliate, (ii) requests made to provide an endorsement and (iii) any compensation received by the endorser for its endorsement.

If it is determined that the Affiliate has failed to comply with this Code of Conduct once in a period of three months, Affiliates.Network will issue it with a warning. If it is determined that the Affiliate has not complied with this Code of Conduct for a second time in a period of three months, Affiliates.Network will terminate the cooperation with this Terminate Affiliate Promoting the Service and the Websites.

All other codes of conduct included in the Code of Conduct apply mutatis mutandis to a Website/Whitelabel requested by an Affiliate.

Each Affiliate must comply with all laws, rules and regulations that are applicable to their activities, including but not limited to those pertaining to marketing, privacy, social media, consumer protection and advertising.

Each Affiliate must further comply with all applicable industry best practices and guidelines.

Article 4: Limitations, Waivers and Indemnification

Our Services are provided “as is” and without warranty. We cannot guarantee that our Website will be free of glitches, errors, viruses, trojan horses, worms, or other harmful code, or interruptions. Affiliates agree to waive all special, indirect, incidental, or consequential damages of any kind whatsoever, even if we have been advised in advance of the possibility and extent of such damages, which result from the use of, or inability to use, our Website, despite the cause. Nor shall we be liable for any delay or failure in performance resulting from causes beyond Our reasonable control.

Each Affiliate is and remains responsible and liable for its actions and Affiliates.Network assumes no responsibility or liability to that respect. For the avoidance of doubt, Affiliates.Network is not responsible for content on third party websites and does not accept any liability for content on third party websites.

The Affiliate hereby expressly waives any and all claims he or she may have, now or in the future, arising out of or relating to this Website, Affiliates.Network, any and all contracts you enter into with Affiliates.Network, and any and all of the Affiliates.Network's products and services.

Article 1: Definitions

  • User: Every visitor and user of the website Affiliates.Network.

Article 2: The purpose of processing Personal Data

Primarily, personal data is processed by Affiliates.Network to the extent necessary in connection with the user's registration to become an affiliate of Affiliates.Network and the implementation of affiliate agreements between the user and Affiliates.Network, including, among other things, handling and checking the registration of the user on the website, assigning the user an account on the website and making payments to the user if income has been generated by him on the basis of an affiliate agreement. In the context of affiliate agreements, IP addresses and other data are also used to operate the Affiliates.Network.

Affiliates.Network collects data to operate effectively and provide the user with the best services, including regular business operations and creating personalized marketing initiatives. the user provides some of this information directly, such as when the user creates an account through Affiliates.Network, contacts us through Affiliates.Network user, or registers for our business newsletter. If the user no longer wishes to receive such messages, he can unsubscribe in the manner prescribed in these messages.

This privacy statement as well as any other privacy policy of Affiliates.Network does not apply to websites of third parties, nor to websites of the user that are used in the context of affiliate agreements. Those websites are not operated under the responsibility of Affiliates.Network. The user is responsible for applying a correct privacy policy with regard to his own websites that are used in the context of affiliate agreements with Affiliates.Network.

Affiliates.Network may share personal data with third parties, such as regulators or the tax authorities if Affiliates.Network is legally obliged to do so, or sees other reasons to do so and this is permitted within the framework of the law and regulations.

Personal data is only processed by Affiliates.Network to the extent that it is sufficient, relevant and not excessive in view of the purposes for which it is collected and subsequently processed. Affiliates.Network takes the necessary measures to ensure that personal data is correct and accurate, given the purposes for which it is collected and subsequently processed. Personal data will not be further processed by Affiliates.Network in a manner that is incompatible with the purposes for which it was obtained. These purposes are described in more detail in this privacy statement.

In assessing whether a processing is incompatible as referred to in the previous paragraph, Affiliates.Network will in any case take into account:
